1. Agreement to Terms

These Terms of Use ("Terms") govern your access to and use of My-AI, a Telegram-based AI productivity assistant operated by an MSME-registered sole proprietor based in Bangalore, India.

By using My-AI, you agree to these Terms and our Privacy Policy.

If you do not agree, please stop using the service immediately.

2. Eligibility

By using My-AI, you confirm that:

• You have the legal capacity to enter into a binding agreement
• All information you provide is accurate and complete
• You will use the service only for lawful purposes

3. Account Registration

My-AI uses your Telegram account for identification. No separate registration is required.

You agree to:

• Not share your Telegram account with others for using My-AI
• Notify us immediately if you suspect unauthorized use
• Provide accurate information during billing and support

We may suspend accounts that violate these Terms without prior notice.

4. What My-AI Does

My-AI is a Telegram-based AI productivity assistant that lets you:

• Create and manage reminders (one-time and recurring)
• Save notes and tasks
• Upload and analyse documents (PDF, Word, Excel, images)
• Manage calendar events locally
• Set reminders for friends or colleagues
• Chat with an AI assistant for everyday productivity help

All features are delivered through the Telegram messaging platform. No separate app download is required.

5. AI Processing Disclosure

My-AI uses Google Gemini (by Google LLC) to power its AI features.

When you use AI features, the following may be sent to Google for processing:

• Your message text
• Extracted text from uploaded documents
• Voice note transcriptions

We do not sell your content to Google or any third party.

6. Telegram Platform

My-AI operates through Telegram (Telegram Messenger Inc.). We are not responsible for:

• Telegram outages or service interruptions
• Changes to Telegram's platform, policies, or bot API
• Any failures, delays, or errors caused by Telegram's infrastructure

Telegram's own Terms of Service and Privacy Policy govern your use of the Telegram platform independently.

7. Your Responsibilities

You agree not to:

• Upload unlawful, harmful, abusive, or offensive content
• Use My-AI for any illegal purpose under Indian or applicable law
• Attempt to reverse engineer, hack, or misuse the service or its AI systems
• Use automated scripts, bots, or tools to interact with My-AI
• Share your account access with others
• Use My-AI for bulk, commercial, or resale purposes without written permission
• Impersonate any person or entity
• Abuse the reminder, messaging, or document features

You are solely responsible for all content you upload, create, or share through My-AI.

8. Your Content

You retain full ownership of everything you upload or create in My-AI.

By using My-AI, you grant us a limited, non-exclusive licence to:

• Store your content securely on India-hosted servers
• Encrypt and protect it
• Process it through Google Gemini solely to deliver AI features to you
• Transmit it as necessary to provide the service

This licence ends when you delete your account or request data deletion.

We do not claim ownership of your content. We do not use your content for advertising or training AI models.

9. Subscriptions & Payments

Some features of My-AI require a paid subscription.

Subscriptions are billed through DodoPayments and support UPI, debit cards, credit cards, and other available payment methods.

9.1 Current Plans

All prices are inclusive of GST unless stated otherwise.

We reserve the right to change pricing at any time. Existing subscribers will be notified before any price change affects their renewal.

9.2 No Refund Policy

We do not offer refunds except where required by applicable Indian law.

Once a subscription is activated, it is non-refundable. Please review the plan features carefully before subscribing.

9.3 Plan Upgrades

• You may upgrade your plan at any time
• Your previous plan ends immediately upon upgrade
• Unused days or credits from the previous plan are not refunded
• We may at our sole discretion offer a discount or adjusted pricing on upgrades
• All upgrade transactions are final and non-reversible

9.4 Cancellation

• You may cancel your subscription at any time
• Access continues until the end of your current paid billing period
• No partial refunds are provided for unused time after cancellation

9.5 GST & Taxes

All displayed prices include applicable Goods and Services Tax (GST) unless expressly stated otherwise. We comply with the Central Goods and Services Tax Act, 2017 and the Integrated Goods and Services Tax Act, 2017.

You are responsible for providing accurate billing and location information. Any liability arising from incorrect information provided by you shall be borne by you.

We reserve the right to revise pricing to reflect changes in applicable tax laws or rates.

9.6 Fair Use & Throttling Policy

All plans, including those with higher or unlimited usage limits, are subject to our Fair Use Policy. We reserve the right to:

• Throttle or temporarily limit usage for any account consuming resources disproportionately compared to average users
• Reduce feature availability during periods of high server load
• Adjust stated limits at any time with reasonable notice to users
• Suspend or restrict accounts used in an automated, abusive, or unusually heavy manner

"Unlimited" where mentioned refers to no hard cap under normal personal productivity use. It does not mean unrestricted, unmonitored, or commercial-scale usage.

My-AI is designed for individual personal productivity use only. Bulk, automated, or commercial-scale usage is not permitted under any plan without explicit written agreement from us.

We will always try to notify users before applying restrictions. However, in cases of abuse or infrastructure protection, restrictions may be applied immediately without prior notice.

10. Account Termination

You may stop using My-AI at any time by blocking or deleting the bot on Telegram.

To request full account and data deletion, contact us at merabrand.dev@gmail.com.

Upon deletion:

• Your active data is removed within 30 calendar days
• Billing and financial records are retained as required by Indian law
• Minimal identifiers may be kept up to 1 year for fraud prevention only

We may suspend or terminate your access at any time for:

• Violation of these Terms
• Abusive or fraudulent behaviour
• Legal or regulatory requirements
• Protection of other users or our infrastructure

11. Intellectual Property

All rights in My-AI — including the bot, name, branding, design, features, and underlying technology — are owned by the operator of My-AI.

You receive a limited, non-exclusive, non-transferable, revocable licence to use My-AI for personal productivity purposes only.

You may not copy, modify, distribute, sell, or reverse engineer any part of My-AI.

12. Limitation of Liability

To the fullest extent permitted by Indian law, My-AI and its operator shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of data caused by user error or negligence
• Failures or errors caused by third-party services (Google Gemini, Telegram, DodoPayments)
• Inaccurate, incomplete, or misleading AI-generated responses
• Any loss arising from unauthorised access to your account

Our total liability to you shall not exceed the total amount you paid to My-AI in the 12 months preceding the claim.

Nothing in these Terms excludes liability where such exclusion is not permitted under applicable Indian consumer protection law.

13. Disclaimers

• My-AI is provided "as is" and "as available" without warranties of any kind
• We do not guarantee uninterrupted, error-free, or perfectly accurate service
• AI-generated content may be incorrect — always verify before acting on it
• We are not responsible for decisions you make based on AI outputs
• We are a solo-operated product and may have occasional downtime for maintenance

14. Data Protection

Your use of My-AI is governed by our Privacy Policy, which forms part of these Terms.

We implement:

• TLS encryption for data in transit
• AES-256 encryption for data at rest
• Access strictly limited to the developer only
• India-hosted servers for all user data

15. Governing Law & Disputes

These Terms are governed by the laws of India.

Any disputes arising from or related to these Terms or My-AI shall be subject to the exclusive jurisdiction of courts in Bangalore, Karnataka, India.

We encourage you to contact us first at merabrand.dev@gmail.com to resolve any issue informally before pursuing legal action.

16. Updates to These Terms

We may update these Terms as the service evolves. Material changes will be communicated via:

• A message from the My-AI Telegram bot
• Email (if you have provided one)

Continued use of My-AI after changes are notified constitutes your acceptance of the updated Terms.
